Perhaps, but not yet. The bad news came yesterday as a New York judge dismissed the case and claims of both Amazon and Overstock who filed lawsuits to stop the Internet sales tax collection. Count on both Amazon and Overstock, however, to appeal the rulings.&lt;br /&gt;&lt;br /&gt;According to Judge Eileen Bransten, &amp;quot;In the end, the Commission-Agreement Provision does not broadly tax any and all Internet sales to New York consumers. It requires a substantial nexus between an out-of-state seller and New York through a contract to pay commissions for referrals with a New York resident along with realization of more than $10,000 of revenue from New York sales earned through the arrangement. The neutral statute simply obligates out-of-state sellers to shoulder their fair share of the tax collection burden when using New Yorkers to earn profit from other New Yorkers.&amp;quot; &lt;br /&gt;&lt;br /&gt;Should Amazon and Overstock ultimately lose their appeals, it is possible that you may see the end of affiliate advertising programs in their current iteration from retailers like Amazon and Overstock. &lt;/p&gt;

results indicates that high shipping costs drive people to shop in stores versus 
free shipping that drives people to shop online.&lt;/p&gt;
&lt;p&gt;&lt;i&gt;Key findings highlighted in the Free Shipping report include: &lt;/i&gt;&lt;/p&gt;

&lt;li&gt;Free shipping is becoming commonplace and highly satisfies shoppers when 
available. Of holiday shoppers, 68% recall seeing an offer for free shipping this 
year. &lt;/li&gt;
&lt;li&gt;Free shipping can be an effective acquisition tool. Free shipping results in 
positive bottom line impact for the e-retailer, surprisingly even when 
restrictions are put on free shipping, such as $100 minimum orders.&lt;/li&gt;
&lt;li&gt;Shipping costs affect whether people choose to buy online or offline. Of 
all shoppers, 18% said avoiding shipping costs is the main reason they choose to buy 
in a store, and 33% said free shipping encouraged online buying.&lt;/li&gt;
&lt;li&gt;Free shipping helps online retailers beat out their competitors. Sixty percent said 
free shipping influenced which retailer to choose when purchasing.&lt;/li&gt;

The mcomScore holiday retail survey, conducted from November 28 - December 1, revealed several interesting insights into consumers&amp;#39; views of the 2008 holiday shopping season, including:&lt;br /&gt;&lt;br /&gt;&lt;i&gt;-- More than half (51 percent) of consumers indicated that the level of promotions and discounts is higher this year than last year, while only 12 percent said that there appeared to be fewer, suggesting that retailers are having to be more aggressive in discounting to spur consumer spending.&lt;/i&gt;&lt;br /&gt;&lt;br /&gt;&amp;quot;Mark Twain might have said: &amp;#39;Rumors of the death of online holiday shopping have been greatly exaggerated,&amp;#39;&amp;quot; said comScore chairman Gian Fulgoni. &amp;quot;Consumers are clearly responding positively to retailers&amp;#39; aggressive online discounts. With Cyber Monday promotions beginning in earnest over the Thanksgiving weekend, consumers have finally begun to open their wallets, setting off a streak of four consecutive days of extremely strong growth, and culminating in a Cyber Monday that racked up an impressive $846 million in online spending, up 15 percent over last year and ranking it as the second heaviest online spending day on record. This is an extremely encouraging development for retailers and we can but hope that their aggressive discounting has still left room for profits.&amp;quot;&lt;/p&gt;
